released a list of 2007
annualized employee

She defends the delay by saying the manner in which the list was composed is not required under the West Virginia "Sunshine Law" statute.
"As you know the City of Nitro does not have the staffing to accommodate requests for information where information has to be compiled and created within the five day rule under WV Code 29B, which at the point of creating information we are no longer compelled to reply under the statutory requirement," says Terry.
In a previous article published on PutnamLIVE.com, Nitro resident Karen Fritz criticized Terry for not releasing copies of government records in a timely manner. "I've tried in vain several times through FOIA to get info from Tifney Terry," says Fritz. "On the last FOIA, Tifney told me to go to city hall and look through the boxes myself."
"Ms. Fritz has never been denied any of the information she has requested," responds Terry. "She has been given all information she has requested - either in the form of actual copies or where the information she requested to view was so voluminous she was given access to the actual records so that she could determine what she wanted actual copies of. (The request I believe she was referring to was for more than 4 years worth of records.)"
"I asked Tifney for the name of any and all bank accounts open/closed that Nitro had or has used in the past five years," clarifies Fritz. "Being treasurer, she should easily know what the bank accounts were, especially for the period that she had worked there. She could have checked the city's records for the three previous years and given me that info. Should have been no big hassle for her. That shouldn't have been so difficult."
Terry says the delay in responding to PutnamLIVE.com was due to her taking a couple of days off in late March, which was planned long before our request was filed.
And on a personal note, Terry says, despite comments by Nitro Mayor Rusty Casto, she did not get married over the weekend. "I don't know why he said that," says Terry, "I did not get married."
